These Terms of Service ("Terms") govern your access to and use of the services, platform, and applications (the "Service") provided by Hunter Networks ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Services Overview

Hunter Networks provides IT management, business phone systems, unified communications, and related technology services designed for dental clinics, law firms, medical offices, and small businesses. Our platform includes SMS and MMS messaging, voice calling, fax services, web chat, appointment reminders, payment processing, and contact management.

2. Account Registration
  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must notify us immediately of any unauthorized access to or use of your account.
  • You are responsible for all activities that occur under your account, including actions taken by other users you authorize within your organization.
  • You must be at least 18 years of age to create an account.
3. Acceptable Use

You agree not to use the Service to:

  • Send unsolicited bulk messages (spam), including SMS, MMS, or fax communications that violate the Telephone Consumer Protection Act (TCPA) or CAN-SPAM Act.
  • Transmit any content that is unlawful, harassing, threatening, defamatory, or otherwise objectionable.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems.
  • Use the Service for any purpose that violates applicable local, state, national, or international law.
  • Transmit viruses, malware, or other harmful code through the Service.
4. Communications Compliance

When using our SMS, voice, and fax services, you are responsible for complying with all applicable telecommunications laws and regulations, including but not limited to:

  • TCPA: Obtaining proper consent before sending automated messages or making automated calls.
  • CAN-SPAM Act: Including opt-out mechanisms in commercial messages.
  • HIPAA: If you are a healthcare provider, ensuring that any protected health information (PHI) transmitted through the Service is handled in accordance with HIPAA requirements.
  • 10DLC/A2P Registration: Complying with carrier registration requirements for application-to-person messaging.
5. Payment Terms
  • Service fees are billed according to your selected plan and usage. Details are provided at the time of enrollment.
  • Payment processing is handled by Stripe. By using our payment features, you also agree to Stripe's terms of service.
  • If you use our integrated payment collection features to charge your customers, you are responsible for complying with all applicable payment card industry (PCI) standards.
  • Overdue balances may result in suspension or termination of your account after reasonable notice.
6. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Hunter Networks. The Service is protected by copyright, trademark, and other applicable laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

7. User Content

You retain ownership of all content you submit through the Service, including messages, contacts, files, and business data. By using the Service, you grant us a limited license to store, process, and transmit your content solely to provide and improve the Service. We will not use your content for any other purpose without your consent.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

9. Limitation of Liability

To the maximum extent permitted by law, Hunter Networks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or continuously available.

11. Indemnification

You agree to indemnify and hold harmless Hunter Networks, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms, with or without notice. Upon termination, your right to use the Service will immediately cease. You may request a copy of your data within 30 days of termination.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Hunter Networks operates, without regard to conflict of law principles.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
